1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your access to and use of www.byramhealthcare.com, as well as our mobile applications, patient portals, and any related digital services, features, or platforms we operate (collectively, the “Platform”), which is owned and operated by Byram Healthcare Centers, Inc. (“Byram,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms and any policies incorporated by reference. If you do not agree, do not use the Platform.
You represent that you are at least 18 years old and legally able to enter into a binding agreement.
2. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
3. Purpose of the Platform; No Medical Advice
The Platform is provided to:
- Offer general information about Byram and its services;
- Allow patients or authorized users to enroll, manage accounts, request insurance-covered supplies, submit reorders, and make payments;
- Facilitate customer service communications.
The Platform does not provide medical advice. Information on the Platform is not a substitute for professional medical advice, diagnosis, or treatment. In an emergency, call 911 or contact your healthcare provider.
4. Relationship to Other Agreements
Your use of the Platform is separate from, and does not replace, any written agreement you may have with Byram governing the provision of medical supplies, services, insurance billing, rentals, or payments.
If there is a conflict between these Terms and a separate written agreement with Byram, the written agreement controls with respect to products and services.
5. Privacy & Accessibility
Our collection, use, and disclosure of information through the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference:

6. Accounts and Security
You may be required to create or access an online account to use certain Platform features. We may use third-party service providers to support authentication, identity verification, and account security features, including multi-factor authentication and one-time passcodes.
You agree to:
- Provide accurate and current information;
- Maintain the confidentiality of your login credentials;
- Be responsible for all activity occurring under your account.
While we implement reasonable administrative, technical, and physical safeguards, no system can be guaranteed to be completely secure. You must notify us immediately of any unauthorized use or security incident. We may suspend or terminate access to accounts that violate these Terms or applicable law.
7. Enrollment, Requests, Reorders, and Payments
The Platform may permit you to:
- Submit enrollment information;
- Request or reorder insurance-covered medical supplies;
- Review account information;
- Submit payments for amounts due.
All supply requests and reorders are subject to:
- Verification of insurance coverage and eligibility;
- Receipt of valid prescriptions or medical documentation where required;
- Applicable payer, regulatory, and clinical requirements.
Submission of a request through the Platform does not guarantee approval, coverage, or fulfillment.
Byram reserves the right to decline, modify, or delay fulfillment as permitted by law.
8. Communications; Texting and Call Consent
By providing a telephone number or email address through the Platform, you consent to being contacted by Byram and its agents for purposes related to:
- Your account;
- Enrollment, fulfillment, and reorders;
- Billing and payment matters;
- Customer service and operational communications.
These communications are intended to be transactional or operational in nature and are not intended for marketing or promotional purposes.
Such communications may include calls or text messages, including those made using automated dialing technologies or prerecorded/artificial voice messages, to the extent permitted by law.
This includes communications initiated through the Platform, including mobile applications and authentication-related messages such as one-time passcodes.
Message and data rates may apply. You may opt out of text messages at any time by replying STOP, where applicable, or by contacting customer service.
Calls may be monitored or recorded for quality assurance and training, as permitted by law.
9. Intellectual Property
All Platform content, including text, graphics, logos, images, software, and design, is owned by Byram or its licensors and is protected by U.S. and international intellectual property laws.
You are granted a limited, non-exclusive, revocable license to access and use the Platform for personal, lawful, non-commercial purposes related to your relationship with Byram.
You may not copy, modify, distribute, reverse engineer, or exploit Platform content without prior written consent.
10. User Submissions
If you submit comments, feedback, or other content through the Platform:
- You represent that you have the right to submit such content;
- The content must not be unlawful, defamatory, infringing, or misleading.
You grant Byram a non-exclusive, royalty-free, worldwide license to use such submissions for business and operational purposes. Byram has no obligation to review or retain submitted content.
11. Prohibited Uses
You agree not to:
- Use the Platform in violation of any law or regulation;
- Attempt to gain unauthorized access to systems or data;
- Introduce malware or harmful code;
- Interfere with Platform functionality or security.
12. Third-Party Links
The Platform may contain links to third-party websites. Byram does not control or endorse those sites and is not responsible for their content or practices.
13. Platform Availability and Disclaimers
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, Byram disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free operation of the Platform.
14. Limitation of Liability
To the maximum extent permitted by law, Byram will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Platform.
Byram’s total liability for any claim related to the Platform will not exceed $100, unless applicable law requires otherwise.
15. Indemnification
You agree to indemnify and hold harmless Byram and its affiliates from any claims, damages, or expenses, including attorneys’ fees, arising from your violation of these Terms or misuse of the Platform.
16. Governing Law; Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles.
Any legal action arising out of or relating to these Terms or the Platform must be brought exclusively in the state or federal courts located in the State of New York, and you consent to personal jurisdiction in those courts.
17. Termination
We may suspend or terminate access to the Platform at any time for violation of these Terms or for operational or security reasons. Sections that by their nature should survive termination will survive.
